Daniel Reback
Daniel Reback has been a member of Nemecek & Cole since February 2022.
Mr. Reback is a member of the California State Bar and licensed to practice law before all California State courts, the United States District Court for the Central District of California, and the United States Court of Appeals for the Ninth Circuit. He is also a member of the Los Angeles County Bar Association and the American Bar Association.
Mr. Reback has a diverse litigation practice which includes litigating business and real estate disputes, employment practices, intellectual property matters, and personal injury claims. He has conducted jury and bench trials, and argued numerous times at the California Court of Appeal and the United States Court of Appeals for the Ninth Circuit.
Mr. Reback has litigated a wide variety of business disputes, including claims for breach of contract and breach of fiduciary duty, and claims arising from the purchase and sale of real property. He also has represented clients in all types of homeowner associations’ matters. Mr. Reback’s practice also includes representing attorneys in legal malpractice and breach of fiduciary duty actions.
In the area of employment law, Mr. Reback has litigated claims involving harassment, discrimination, retaliation, wrongful termination, and wage disputes. His general liability experience includes litigating product liability, premises liability, and construction defect claims. As both a seasoned litigator and insurance risk strategist, Mr. Reback has wide-ranging experience handling insurance coverage disputes as well.
In the area of entertainment and intellectual property litigation, Mr. Reback has litigated claims involving trademark infringement, copyright infringement, idea theft, and trade secret cases. Most recently, he served as lead counsel representing the owner of the famous trademark “Honey Badger Don’t Care” in trademark infringement actions throughout the country, securing substantial recoveries for his client. Mr. Reback also argued before the United States Court of Appeals for the Ninth Circuit, and obtained reversal of the trial court’s granting of summary judgment in a 25-page unanimous published decision, Gordon v. Drape Creative, Inc., 909 F.3d 257 (9th Cir. 2018). Well-known legal publication Law360 ranked this appellate decision in its Top 10 trademark rulings of 2018 in the United States, coming in at number five nationally, and ranking as the most significant trademark ruling in all of the Ninth Circuit for 2018. Law360 noted the Honey Badger ruling was “a rare success for a trademark case over an expressive work.” This precedent-setting decision was featured in newspapers and publications throughout the country including The Washington Post, and Mr. Reback appeared on MSNBC’s nationally-televised show The Beat with Ari Melber to discuss the important decision.
Mr. Reback has also secured favorable results for his clients in catastrophic personal injury cases.
At Loyola Law School, Mr. Reback was on the Dean’s List, earned the prestigious First Honors Award in both Appellate Advocacy and Labor Law, and was a member of the Entertainment Law Review. After graduation, Mr. Reback was a litigator at Stroock & Stroock & Lavan LLP where he handled complex insurance coverage matters. Mr. Reback has also been named by his peers as one of Southern California’s Super Lawyers “Rising Stars”.
